These Terms of Service ("Terms") govern access to pets.myoffices.cc and purchases from Barkleon ("Barkleon," "we," "us," or "our"). By using the site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the site.

1. Eligibility and lawful use

You must be at least 18 years old or the age of majority where you live and legally capable of entering a contract. You may use the site only for lawful, personal, non-commercial purposes. You may not misuse the site, interfere with security or operation, introduce malicious code, scrape or copy content without permission, impersonate another person, submit false information, or violate another person's rights.

2. Products and pet safety

Barkleon sells consumer pet accessories. Our products and site content are not veterinary, medical, behavioral, legal, or other professional advice and are not substitutes for advice from a qualified professional. Product suitability depends on your pet's size, strength, health, temperament, training, and environment.

You are responsible for selecting the correct product and size, following all instructions and warnings, inspecting the product before every use, supervising your pet, and discontinuing use if the product is damaged, worn, chewed, altered, or unsuitable. Unless a product page expressly says otherwise, our products are not life-saving devices, child-safety devices, vehicle crash restraints, or equipment for unattended tethering. No leash, connector, bag, scooper, or accessory can eliminate the inherent risks of handling animals or being outdoors.

3. Product information

We make reasonable efforts to display descriptions, dimensions, colors, photographs, availability, and pricing accurately. Screens, lighting, manufacturing tolerances, packaging changes, and supplier updates may cause minor variations. We may correct typographical, pricing, availability, or descriptive errors and may update information before accepting an order. We will not substitute a materially different product without your consent.

4. Orders and acceptance

An order is an offer to purchase. An automated confirmation acknowledges receipt but does not mean we accepted the order. We may accept, limit, or cancel an order for lawful reasons, including inventory error, suspected fraud, pricing error, payment failure, shipping restriction, or supplier unavailability. If we cancel after payment, we will refund the affected amount to the original payment method.

You must provide current, complete, and accurate billing, shipping, and contact information. You authorize us and our payment providers to charge the amounts shown at checkout, including applicable taxes and shipping. You are responsible for safeguarding account credentials and for activity under your account to the extent permitted by law.

5. Prices, taxes, and payment

Prices are in U.S. dollars unless stated otherwise. Prices and promotions may change prospectively without notice. Applicable taxes, shipping, discounts, and total charges are shown at checkout. Payment services are provided by Shopify and other independent payment providers under their own terms. We do not store full payment-card numbers.

6. Fulfillment and delivery

We may use independent manufacturers, suppliers, fulfillment partners, carriers, and technology providers to process and ship orders. Estimated processing and transit times are governed by our Shipping Policy and are not guarantees unless expressly identified as guaranteed. Title and risk allocation, delayed shipment remedies, and non-delivery remedies remain subject to applicable law.

7. Returns and refunds

Returns, cancellations, damaged-item claims, and refunds are governed by our Return and Refund Policy. Nothing in these Terms limits a remedy that cannot lawfully be limited.

8. Intellectual property

The site and its original text, graphics, logos, layout, photographs, and other content are owned by or licensed to Barkleon and protected by applicable intellectual-property laws. Except for ordinary personal shopping use, no license is granted. Third-party marks remain the property of their owners. Reviews or other content you submit must be truthful and lawful. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, and display submitted content for operating and promoting the store, subject to our Privacy Policy.

9. Third-party services and links

The site may use or link to services operated by Shopify, payment processors, carriers, suppliers, or other third parties. We do not control independent third-party sites or their terms, security, content, or availability. A link does not imply endorsement. This section does not excuse us from obligations that applicable law places on us as the seller.

10. Disclaimer of additional warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY CLEARLY PROVIDED ON A PRODUCT PAGE, THE SITE, SITE CONTENT, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." BARKLEON DISCLAIMS ALL WARRANTIES NOT REQUIRED BY LAW, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

This disclaimer does not exclude any warranty, guarantee, representation, or consumer right that cannot lawfully be excluded. We do not warrant that the site will be uninterrupted, error-free, secure, or free from harmful components. Manufacturer warranties, if any, are provided by the manufacturer under its terms and do not create an additional Barkleon warranty unless we expressly state otherwise.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BARKLEON AND ITS OWNERS, PERSONNEL, AFFILIATES, SERVICE PROVIDERS, AND FULFILLMENT PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM MISUSE, UNAUTHORIZED MODIFICATION, NORMAL WEAR, FAILURE TO FOLLOW INSTRUCTIONS, UNSUPERVISED USE, OR USE WITH AN UNSUITABLE PET.

To the fullest extent permitted by law, Barkleon's aggregate liability arising from a product, order, or use of the site will not exceed the amount you paid Barkleon for the specific product or order giving rise to the claim. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury to the extent such liability cannot be limited, our obligation to refund amounts when required by law, or any statutory consumer right or other liability that applicable law does not permit us to exclude or limit. Some jurisdictions do not permit certain exclusions, so parts of this section may not apply to you.

12. Indemnification

To the extent permitted by law, you agree to defend and indemnify Barkleon from third-party claims, damages, and reasonable costs to the extent caused by your unlawful use of the site, material breach of these Terms, infringement of another person's rights, or intentional misuse or unauthorized modification of a product. This section does not require a consumer to indemnify Barkleon for Barkleon's own negligence, misconduct, product defect, or non-waivable legal duty.

13. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil disorder, labor disruption, epidemic, government action, carrier disruption, utility failure, cyberattack, or supplier interruption, provided this section does not remove any cancellation, notice, refund, or other remedy required by law.

14. Suspension and termination

We may suspend or terminate access to the site for fraud, abuse, security risk, unlawful conduct, or material breach of these Terms. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, and dispute provisions.

15. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before filing a claim, the parties should attempt in good faith to resolve it through our Contact page. Subject to any mandatory consumer venue or jurisdiction right, claims may be brought in a court of competent jurisdiction located in Ulster County, New York. These Terms do not require arbitration and do not waive any right that cannot lawfully be waived.

16. Changes, severability, and entire agreement

We may update these Terms prospectively by posting the revised version and date. Material changes apply to future site use and orders unless law permits otherwise. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies incorporated above are the entire agreement for use of the site and purchases from Barkleon, except for any separate written agreement signed by us.
